By accessing and using the AskERP platform, website, and services (collectively, "the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our Service. AskERP reserves the right to modify these terms at any time, and your continued use of the Service constitutes your acceptance of any changes.
AskERP is a comprehensive enterprise resource planning (ERP) platform designed to streamline business operations across multiple industries including education, healthcare, manufacturing, corporate, hospitality, and non-profit sectors. Our platform provides integrated modules for financial management, human resources, inventory, customer relationship management, project management, and industry-specific solutions.
The Service is provided on an as-is, as-available basis. We strive to maintain continuous availability, but do not guarantee uninterrupted access due to maintenance, updates, or unforeseen circumstances.
To access most features of AskERP, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide truthful information and immediately notify us of any unauthorised access to your account. AskERP reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity. You are liable for all charges incurred under your account.
Pricing Structure: AskERP offers custom pricing based on your organisation's size, modules selected, users, and implementation requirements. Detailed pricing is available upon request by contacting our sales team.
Free Trial: New users may be eligible for a free trial period (typically 14-30 days) with full or limited access to features. Free trials are for evaluation purposes only and expire automatically unless upgraded to a paid subscription.
Paid Subscriptions: Subscriptions are billed monthly or annually based on your agreement. Payment is due at the beginning of each billing period. We accept various payment methods including credit cards, bank transfers, and automated payment systems.
Billing Cycle: Your billing cycle starts on the date your subscription is activated. Charges for the next billing period will be processed automatically unless you cancel your subscription before the renewal date.
Refund Policy: We do not offer refunds for partial months of subscription use. Refund requests must be submitted within 7 days of charge. Enterprise customers should refer to their specific agreement for refund terms.

You agree not to use AskERP for any illegal, unethical, or harmful purposes. Prohibited activities include:
Uploading, transmitting, or storing malware, viruses, or harmful code; accessing or attempting to access systems without authorisation; reverse-engineering, decompiling, or attempting to derive the source code; using the Service for unauthorised mass emails, phishing, or other abusive practices; violating intellectual property rights of others; accessing or using data of other users without permission; using the Service in ways that could damage, disable, or overburden infrastructure.
Violation of these terms may result in immediate suspension or termination of your account and potential legal action.
AskERP Ownership: All content, software, source code, design, and functionality of the AskERP platform are owned by AskERP and protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service according to these terms.
Your Data: You retain all rights to data and content you upload to AskERP (your "User Data"). By using our Service, you grant AskERP a non-exclusive license to process and host your data for service delivery purposes.
Restrictions: You may not copy, modify, reproduce, or distribute any part of the Service, including software or documentation, without prior written permission from AskERP.
AskERP is committed to protecting your data and complying with all applicable data protection laws. Our practices are detailed in our Privacy Policy, which forms an integral part of these terms.
We implement industry-standard security measures including encryption, access controls, and regular audits to protect your data from unauthorised access, loss, or alteration. However, no system is completely secure, and we cannot guarantee absolute data security.
By using AskERP, you understand that data transmission over the internet carries inherent risks. You agree to accept these risks and acknowledge that AskERP cannot be held liable for data breaches resulting from unforeseen security vulnerabilities beyond our reasonable control.
Service Level Agreement (SLA): We strive to maintain high availability of our Service. Enterprise customers are covered by a 99.9% uptime SLA, meaning the Service will be available at least 99.9% of the time in any given month, excluding scheduled maintenance.
Scheduled Maintenance: We perform regular maintenance to improve and secure the Service. Maintenance windows are typically scheduled outside business hours and announced in advance when possible.
Unplanned Downtime: We work diligently to minimise unplanned outages, but occasional service interruptions may occur due to factors beyond our control, including natural disasters, network failures, or cyber attacks.
No Liability for Downtime: Except for Enterprise customers with a documented SLA, AskERP is not liable for damages resulting from service unavailability, including lost revenue or data.
To the maximum extent permitted by law, AskERP shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business interruption, even if advised of the possibility of such damages.
Our total liability for any claim arising from the Service shall not exceed the amount paid by you to AskERP in the 12 months preceding the claim.
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
Termination by You: You may terminate your subscription at any time by providing written notice to AskERP. Termination is effective at the end of your current billing period. No refunds are provided for early termination.
Termination by AskERP: AskERP may terminate or suspend your account immediately if you violate these terms, engage in unauthorised use, or violate applicable laws. We may also terminate service for business reasons with 30 days' written notice.
Data Deletion: Upon termination, you may request export of your data. We will delete your data within 30 days of termination, except where legally required to retain it.
These Terms of Service are governed by the laws of India. You agree to submit to the exclusive jurisdiction of the courts located in India for any disputes arising from these terms or your use of the Service.
If you are located outside India, you acknowledge that you are subject to Indian law and agree to comply with all applicable local laws in your jurisdiction.
